1) Scope of Application

1.1 These Terms and Conditions (GTC) of BG Investment GmbH (“Seller”) apply to all contracts between the Seller and a buyer (“Client”) for goods and/or services listed in the Seller’s online shop. The Client’s own conditions are excluded unless expressly agreed otherwise.

1.2 By using the Seller’s website, the Client agrees to these GTC.

1.3 The Seller may amend these GTC at any time. Clients will be notified of significant changes at least 30 days in advance. Continued use of the Seller’s services after such changes take effect constitutes agreement to the revised GTC.

1.4 The Client agrees to electronically access, sign, and authenticate documents as per applicable electronic signature laws. These documents may be retained in electronic format and treated as “transferable records.”

2) Conclusion of the Contract

2.1 Product descriptions in the Seller’s online shop do not constitute binding offers but invite the Client to submit an offer.

2.2 Clients submit offers via the online order form by completing the purchase process.

2.3 The Seller may accept the Client’s offer within five days by:

• Sending a written order confirmation (via fax or email), or

• Dispatching the ordered goods, or

• Requesting payment after order placement.

If the Seller does not accept within five days, the Client is no longer bound by their order.

2.4 The acceptance period starts the day after the Client submits the offer and ends on the fifth day.

2.5 The Seller stores the contract’s content and provides it to the Client in writing after order submission. It is not accessible via the website post-order.

2.6 The Client can correct entered data before finalizing the order. A confirmation window also allows for corrections.

2.7 The contract is available in English only.

3) Return Policy

We offer a 30-day return policy. Clients may initiate returns by contacting us at support@sportsharpgear.com.

Accepted returns will receive a shipping label and instructions. Unrequested returns are not accepted.

Non-returnable items: Sale items and gift cards.

Returns must be in original condition with tags and proof of purchase. Items should be sent to:

If your item is defective or incorrect, please contact us immediately.

Refunds are processed within 10 business days of approval. If over 15 business days have passed without a refund, contact support@sportsharpgear.com.

4) Price and Delivery Costs

4.1 Prices are in USD, excluding taxes and shipping costs. Errors in pricing will be corrected before processing orders.

4.2 Clients bear additional costs such as bank transfer fees and customs duties for U.S. deliveries.

4.3 Payment methods are specified in the Seller’s online shop.

5) Shipment and Delivery Conditions

5.1 Orders are delivered to the address provided by the Client unless otherwise agreed.

5.2 If an item is unavailable, the Seller will notify the Client. Clients may opt for a substitute or cancel the order for a refund.

5.3 If delivery fails due to the Client, the cost of failed dispatch is borne by them.

6) Warranty

The Seller disclaims implied warranties of merchantability or fitness for a specific purpose. The Seller is not liable for indirect, special, or consequential damages beyond the purchase price of goods. Some jurisdictions may not allow exclusions, in which case such exclusions are limited to the extent required by law.

7) Limitation of Liability Regarding the Use of the Seller’s Online Shop

7.1 The Seller’s online shop is provided “AS IS” without warranties.

7.2 The Seller is not responsible for virus infections resulting from website use.

7.3 External links provided on the website are not under the Seller’s control, and the Seller is not liable for their content.

7.4 Some jurisdictions may not allow the exclusion of implied warranties; in such cases, exclusions apply only to the extent permitted by law.

8) Limitation of Action

Any claims arising from this contract must be filed within 12 months from when the basis of the claim is discovered.

9) Governing Law

This contract is governed by the laws of the Federal State of Illinois, excluding the UN Convention on Contracts for the International Sale of Goods.

10) Designation of Forum

Legal actions related to this contract must be filed in the courts where the Seller’s business is located. Both parties consent to this exclusive jurisdiction.
